The short version
- One person, one account. Keep your login to yourself.
- Be honest in exams. Cheating or sharing questions can end your access.
- Paid batches unlock with a single-use access code. Don’t share or resell it.
- Exalyte helps you prepare, but it can’t guarantee your exam results.
- You can stop using Exalyte or ask us to close your account at any time.
1Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and Exalyte Inc. (“Exalyte”, “we”, “us” or “our”). They cover your use of our website, apps and services (together, the “Service”). Together with our Privacy Policy, they make up the whole agreement between you and us about the Service.
By creating an account or using the Service you accept these Terms. If you don’t agree, please don’t use Exalyte.
2Who can use Exalyte
- You must be at least 13 years old.
- If you are under 18, you may use Exalyte only with the knowledge and permission of a parent or guardian, who is also responsible for your use of it.
- You must be able to enter a binding agreement and not be barred from using the Service. If we have suspended or banned you before, please don’t create a new account without contacting us first.
3Your account
- One account per person. If you have a genuine reason for a second account, contact us first. We actively limit duplicate and fake registrations.
- Give us accurate information when you sign up and keep it up to date.
- Keep your password confidential. You are responsible for what happens under your account, so tell us straight away if you think someone else is using it.
- Don’t share, sell, rent or transfer your account.
4What Exalyte provides
Exalyte offers live timed exams, practice, results and analytics, rankings, study materials and batches (groups of exams and resources) to help students prepare for HSC and university admission tests.
Exalyte is a preparation tool. We work hard to make our questions, answers and explanations accurate, but mistakes can happen. We may correct or update content, results and rankings at any time, including after they have been published, and we cannot guarantee any particular exam result, score or admission outcome.
5Batches, access codes and payments
- Free and paid batches. Some batches are free and some are paid. The fee is shown on the batch page before you enrol.
- How paid access works. You arrange payment with our support team, who give you a single-use access code. You redeem the code on the enrolment page to unlock the batch on your account.
- Codes are personal. An access code works once, for one account. Don’t share, resell or publish codes. Codes that are shared or resold may be cancelled, along with the access they unlocked, without a refund.
- How long access lasts. Unless a different period is stated when you buy, your access lasts for as long as the batch remains available on Exalyte and your account is in good standing.
- Price changes. We may change prices or stop offering a batch. A price change does not affect access you have already paid for.
Refunds
Access is delivered digitally as soon as you redeem your code, so fees are generally non-refundable once access has been granted. If something went wrong on our side, for example a code that doesn’t work, a duplicate payment or access that was never delivered, please contact us and we will put it right with a replacement code or a refund where appropriate. Nothing in these Terms limits any rights you have under consumer law that cannot be excluded.
6Exam rules and academic honesty
Exalyte exists to help you prepare honestly. In our exams you must not:
- let someone else take an exam for you, or take one for someone else;
- use bots, scripts or other automated tools, or try to change timers, scores or the exam environment;
- use extra or fake accounts to retake exams or gain a ranking advantage;
- copy, record or share questions or answers, especially while a live exam is still running; or
- try to get around any rule or protection we put in place to keep exams fair.
Live exams run in fixed windows and the first scored attempt is the one that counts. Problems with your device, internet connection or power during an exam are your responsibility, so please check them before you start.
We use automated and manual checks to protect fairness. If we find a breach, we may cancel the affected result, remove it from rankings, restrict features, or suspend or end your account.
7Our content and your licence
All Exalyte content, including questions, answers, explanations, images, study materials, software, design, and the Exalyte name and logo, belongs to Exalyte Inc. or its licensors and is protected by law.
While your account is in good standing we give you a limited, personal, non-exclusive, non-transferable licence to use that content on Exalyte for your own preparation. You must not:
- copy, screenshot, record, download in bulk, republish, sell or share exam content or materials outside Exalyte, including in groups, channels, forums or social media;
- scrape or bulk-collect content, or use it to build or train a competing product, dataset or AI model; or
- remove ownership notices from anything we provide.
You are welcome to share your own scores and ranks, and to link to our public batch pages.
If you send us feedback or suggestions, we may use them without owing you anything. If you believe something on Exalyte infringes your rights, please contact us with the details and we will review it.
8Acceptable use
When using Exalyte you must not:
- break any law or the rights of others;
- try to hack, probe, overload, reverse-engineer or bypass the security or access controls of the Service;
- access another person’s account or data;
- upload or send harmful code or spam, including through the contact form;
- impersonate anyone, or harass or abuse other students or our staff; or
- use the Service for anything other than your own learning.
9Third-party links and services
Some study materials link to websites or services run by others, such as file hosting, and you may contact our support team through third-party messaging apps. We don’t control those services and aren’t responsible for them. Their own terms and privacy policies apply when you use them.
10Your information
How we collect and use your information is explained in our Privacy Policy, which forms part of these Terms.
11Suspension and ending your access
By you. You can stop using Exalyte at any time, and you can ask us to close your account through the contact page.
By us. We may limit, suspend or end your access, with notice where practical, if you break these Terms, put the Service or other users at risk, or if the law requires it. Reasons include fake or duplicate accounts, cheating, sharing content or access codes, and abusing the Service or our staff.
If your access ends, your right to use the Service stops. If we end your access because you broke these Terms, you may lose access to your history, materials and any paid batches without a refund. If you think we made a mistake, tell us through the contact page. We will review reasonable requests and our decision after review is final.
Sections about content, liability, governing law and anything else that by its nature should continue will continue after your access ends.
12Availability and changes to the Service
We aim to keep Exalyte running smoothly, but we can’t promise it will always be available or error-free. We may carry out maintenance, add, change or remove features, or pause the Service. Where a change is significant we will try to tell you in advance.
13Disclaimers
To the fullest extent the law allows, the Service is provided “as is” and “as available”, without promises that it will be uninterrupted or free of errors, or that content will always be complete or accurate. Nothing we provide is a guarantee of any exam result or admission. You use the Service, and decide how to act on your performance data, at your own discretion.
14Limits on our liability
To the fullest extent the law allows, neither Exalyte Inc. nor its directors, staff or affiliates will be liable for indirect, incidental, special or consequential losses, or for lost opportunities, lost data or admission or exam outcomes, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.
15Governing law and disputes
These Terms are governed by the laws of Bangladesh. If you have a problem, please contact us first so we can try to sort it out informally. If we can’t, disputes will be handled by the courts of Bangladesh. If you live elsewhere, you also keep any mandatory consumer protections that apply where you live.
16Changes to these Terms
We may update these Terms from time to time, for example when we add features or when laws change. We will update the “last updated” date and, for significant changes, tell you through the platform or by email before they take effect where we can. If you keep using Exalyte after the change you accept the new Terms. If you don’t agree, please stop using the Service.
17General
- Whole agreement. These Terms and the Privacy Policy, plus any batch-specific terms shown when you enrol, are the whole agreement between you and us about the Service.
- If part is unenforceable. If a part of these Terms can’t be enforced, the rest still applies.
- No waiver. If we don’t enforce a right straight away, we haven’t given it up.
- Transfers. You may not transfer your rights under these Terms. We may transfer ours to a related company or to a successor in a merger, acquisition or sale of Exalyte.
- Notices. We may give you notices through the platform or by email to the address on your account.
